About this statute

La ley aprueba la Convención Interamericana sobre Restitución Internacional de Menores. La Convención busca la pronta restitución de menores trasladados o retenidos ilegalmente y el respeto del derecho de visita y de custodia o guarda de sus titulares. For this Convention, a person is considered a minor if they have not completed sixteen years of age. This provision defines custody and visitation rights for a minor. The provision says a minor’s transfer or retention is illegal if it violates the rights that parents, guardians, custodians, or an institution were exercising immediately before the event, under the law of the child’s habitual residence.
