This section identifies Law 689 of 2001 and its preliminary title on special definitions. This article changes two definitions: one for an independent marginal producer or private-use producer, and one for the public sanitation service. This provision amends item 20 of article 14 of Law 142 of 1994 and defines “Servicios Públicos” as all services and complementary activities covered by the law. Regulates how public-service contracts are handled and gives regulation commissions power over exceptional clauses. Varios contracts in article 39 are governed by private law, and contracts in numerals 39.1, 39.2, and 39.3 cannot be assigned, pledged, or used in other contracts without the other party’s prior express approval. If the contract lets the contractor charge regulated public tariffs, the bidder must include the tariff formula in the offer.
