This text identifies Ley 734 de 2002 as the Single Disciplinary Code and introduces the general part and its guiding principles. El Estado es el titular de la potestad disciplinaria; el artículo está derogado desde el 29 de marzo de 2022. Las oficinas de control disciplinario interno y los funcionarios con potestad disciplinaria deben conocer los asuntos disciplinarios de sus dependencias; para funcionarios judiciales, la titularidad corresponde a la jurisdicción disciplinaria, y la acción disciplinaria es independiente de otras acciones. La Procuraduría General de la Nación tiene poder disciplinario preferente y puede intervenir en investigaciones y procesos disciplinarios; también comparten competencia la Judicatura y las personerías indicadas. Regulates that public servants and certain private persons may only be investigated and disciplined for conduct defined as an offence in the law in force when the conduct occurred; the article is noted as repealed from 29 March 2022.
