Preamble to Law 756 of 2002, which states that it modifies Law 141 of 1994, sets distribution criteria, and includes other provisions. The Fondo Nacional de Regalías has its own legal personality, its resources must be used for mining, environmental protection, and priority regional investment projects, and the Government National must regulate the legal personality issue within three months. The National Royalties Fund’s resources must be allocated to mining promotion, environmental preservation, and regional investment projects, with minimum percentage splits set for each use. This provision allocates mining-promotion funds among specific entities and allows territorial entities to run mining-promotion projects if the mining authority approves them. This article defines a “Departamento Productor” as a department whose royalty and compensation income, including that of its producing municipalities, is at least 3% of the country’s total royalty and compensation income.
