This preamble says the instrument is meant to strengthen protection for children against sale, prostitution, and use in pornography. States Parties must prohibit the sale of children, child prostitution, and child pornography, consistent with the Protocol. This article defines “sale of children,” “child prostitution,” and “child pornography” for the protocol. Cada Estado Parte debe adoptar medidas para hacer efectiva su jurisdicción sobre ciertos delitos en casos de territorio, buque o aeronave con pabellón propio, y también cuando el presunto delincuente esté en su territorio y no sea extraditado; además, puede hacerlo en casos de nacionalidad o residencia habitual del presunto delincuente o de nacionalidad de la víctima. The article says certain crimes are treated as extraditable between States Parties, allows a requested State to use the Protocol as a legal basis when there is no treaty, and requires the requested State to send the case to its competent authorities if extradition is refused for nationality reasons.
