This provision is the preamble to Law 793 of 2002, which states that it establishes the rules governing extinción de dominio. This provision defines extinguishment of title as loss of the right in favor of the State, without payment or compensation to the holder. El dominio se declarará extinguido por sentencia judicial cuando los bienes tengan origen o vínculo ilícito, o cuando exista incremento patrimonial injustificado sin origen lícito explicado. Defines which assets count as property subject to forfeiture and requires the prosecutor to present substitute lawful assets when the original assets cannot be located or seized. This article says the extinction-of-domain action is a jurisdictional, real, patrimonial action and may apply to rights and assets, subject to the stated exception for good-faith third parties exempt from fault.
