This preamble identifies Law 836 of 2003 as the military disciplinary regulations and notes that it was later repealed. La potestad disciplinaria corresponde al Estado, y las Fuerzas Militares conocen de los asuntos disciplinarios contra sus miembros, sin perjuicio del poder preferente de la Procuraduría General de la Nación. Las personas a quienes se les atribuya una falta disciplinaria se presumen inocentes hasta que su responsabilidad se declare legalmente en fallo ejecutoriado. The rule says people covered by this regulation can only be investigated and disciplined for conduct that was already described as an offence in the law at the time it happened.
