About this statute

This text is the preamble of Law 1060 of 2006, stating that it modifies the rules governing challenges to paternity and maternity. A child conceived during a marriage or marital union is presumed to have the spouses or permanent partners as parents, unless proven otherwise. A child born more than 180 days after a marriage or declaration of a marital union is presumed to have been conceived within that relationship and to have the spouses or permanent partners as parents, unless the presumption is rebutted. This article repeals Article 215 of the Civil Code. El cónyuge o compañero permanente y la madre pueden impugnar la paternidad del hijo nacido durante el matrimonio o la unión marital de hecho, dentro de 140 días desde que sepan que no es el padre o madre biológico.
