El hábeas corpus se define como un derecho fundamental y una acción constitucional para proteger la libertad personal frente a detenciones ilegales o prolongadas ilegalmente. La solicitud de Hábeas Corpus puede ser resuelta por todos los jueces y tribunales de la Rama Judicial; si se presenta ante una corporación, cada integrante cuenta como juez individual para decidirla. A person unlawfully deprived of liberty has the right to seek habeas corpus, have it decided within 36 hours, have others file it for them, and keep the proceeding moving during holidays or judicial recesses. A habeas corpus petition must include the listed identification, detention, and case details, but missing one item does not stop the case if the information is enough.
