The judge decides preliminary exceptions at the conciliation hearing; prescription may be raised as a preliminary exception only if the due date, interruption, or suspension is not disputed; merits exceptions are decided in the judgment. Los incidentes solo pueden proponerse en ciertas audiencias procesales, salvo si los hechos ocurrieron después; quien los proponga debe presentar las pruebas en esa misma audiencia. The judge must limit how long the parties and their representatives may speak, while respecting the right of defense. This article says there are two hearings: one for conciliation, preliminary exceptions, curing defects, and defining the dispute; and another for procedure and judgment.
