This is the preamble to Law 1210 of 2008, stating that it partially amends parts of the Labor Code and the Code of Labor Procedure and Social Security, and creates article 129A. If a strike lasts 60 calendar days without a solution, the employer and workers may agree on a settlement method within the next 3 business days; if they still cannot agree, the matter goes to a conciliation subcommittee and then arbitration. El Tribunal Superior competente decide en primera instancia si una suspensión o paro colectivo del trabajo es legal o ilegal, y la apelación va a la Sala Laboral de la Corte Suprema de Justicia. La jurisdicción ordinaria laboral y de seguridad social conoce de la calificación de la suspensión o paro colectivo del trabajo.
