About this statute

This preamble states that Law 1273 of 2009 modifies the Penal Code and creates a protected legal interest for information and data, while preserving information and communications technology systems. This article adds cybercrime offences to the Penal Code and sets prison and fine penalties for unauthorized access, interference, interception, data damage, malicious software, personal-data violations, website spoofing, and unauthorized asset transfers. This article adds a circumstance of greater punishment: using computer, electronic, or telematic means to carry out punishable conduct. This provision adds a new item to Article 37 and gives municipal criminal judges competence over the crimes listed in Title VII Bis. This article says the law takes effect when it is promulgated and repeals any contrary provisions, especially article 195 of the Penal Code.
