About this statute

This preamble states that Colombia and Peru concluded an agreement to modify the 1911 Bolivarian Extradition Convention. Los Estados deben entregarse mutuamente las personas investigadas, procesadas o condenadas que estén en el territorio del otro Estado, conforme al Acuerdo. Extradition applies to punishable conduct that carries a custodial sentence of at least one year under the States’ laws, regardless of how the offence is named. The provision repeals article 3 of the Bolivarian Extradition Agreement between Colombia and Peru. La extradición puede negarse si el hecho se considera delito político o conexo, y no se puede juzgar ni sancionar por delitos políticos a una persona entregada bajo este Acuerdo.
