Esta parte introductoria identifica la Ley 1382 de 2010 y dice que modifica la Ley 685 de 2001 (Código de Minas). Applicants for a mining concession must state whether mining exists in the requested area and identify its location and method of detection. The Mining Authority must certify any existing mining within 3 months and decide the concession request within 180 calendar days. La Autoridad Minera y Ingeominas pueden delimitar ciertas áreas mineras especiales y la Autoridad Minera fija el proceso, las condiciones y los pagos para adjudicarlas. No se pueden hacer trabajos y obras mineras en ciertas zonas protegidas; además, hay reglas sobre sustracción de áreas forestales, información al concesionario y plazos para que el Ministerio redelimite esas zonas. The Ministry of Mines and Energy must prepare the National Mining Planning Plan within three years and align it with environmental and land-use policies; the plan must also coordinate with the environmental ministry and include a strategic environmental analysis.
