This preamble identifies Law 1436 of 2011 and states that it grants benefits to the families of people who were kidnapped after performing their public office. Algunos servidores públicos víctimas de secuestro, toma de rehenes o desaparición forzada conservan los beneficios de la Ley 986 de 2005 después de terminar su período, y también los reciben sus familiares y dependientes económicos. Benefits under this article apply only if the kidnapping, hostage-taking, or enforced disappearance happens while the person is disqualified from public employment or professional activity because of the office they held. For benefits under Law 986 of 2005, the reference salary is the updated pay of the person who held the office, using the year before the deprivation of liberty and the legal increases. The benefits are funded by the entity where the public servant worked. Los instrumentos de protección de esta ley aplican a las víctimas de secuestro, toma de rehenes y desaparición forzada, y también a sus familiares y dependientes económicos que sigan en cautiverio al entrar en vigencia la ley.
