This text is the preamble to Law 1527 of 2012, which says it establishes a general framework for payroll lending (libranza) or direct deduction and other provisions. La libranza permite comprar bienes o servicios con descuento del salario, pagos u honorarios, pero el empleador o entidad pagadora debe girar los recursos directamente a la entidad pagadora cuando exista autorización expresa de descuento. Este artículo define términos usados para la libranza o descuento directo y fija algunas obligaciones y exclusiones sobre quién puede operar, girar recursos y registrarse. This article sets conditions for using payroll lending or direct deduction, including prior irrevocable authorization, legal interest-rate limits, and keeping at least 50% of net salary or pension after deductions. The beneficiary may choose the operator used for payroll/fee/pension deduction payments and may ask that deducted funds go to an AFC or similar account. The employer or paying entity may not charge administration fees or commissions for the deduction or transfer, and doing so can trigger a monetary sanction.
