Statute overview

About this statute

Banks covered by this regulation must give customers specified pool information in the required format, keep written pool rules, and report returns on a schedule. A pool may use derivatives for hedging and portfolio management if the use complies with §§ 13-21. The stated limits must be met at the time of investment, and several bond types and fund units are outside subsection 1. Section 20 sets rules for how a pool may use derivatives and how separate custody accounts may hold investments. Companies and other legal persons may be subject to criminal liability under chapter 5 of the Penal Code. The section also explains when savings-related use rights may fall within the ban, including limits and exceptions.
