About this statute

This provision sets the scope and key definitions for the regulation, and it says certain firms must pass on third-party fees or commissions to the customer promptly when they are received. Companies must have procedures to pass received fees, commissions, or other benefits on to the customer and keep the customer informed periodically. Certain firms may not pay such benefits to anyone other than the customer or someone acting for the customer when providing discretionary portfolio management or independent investment advice, subject to stated exceptions.
