This provision introduces investor-protection rules for securities trading and says which firms and activities they cover. Certain investment firms and related institutions must document suitability, ensure retail customers provide accurate portfolio information, and a securities dealer must ask for customer knowledge and experience before assessing whether a product or service is appropriate. Ved krydssalg skal værdipapirhandleren vurdere, om pakken er hensigtsmæssig for kunden, og kunden skal tydeligt advares, hvis produktet eller tjenesteydelsen ikke er hensigtsmæssig eller hvis oplysningerne er utilstrækkelige. I visse execution-only-situationer kan værdipapirhandleren undlade hensigtsmæssighedsvurderingen, hvis flere betingelser er opfyldt. A securities dealer must report to customers, follow transferred customer information and recommendations when trading through another dealer, review its procedures at least yearly, and comply with Finanstilsynet’s supervision; breaches can be fined.
