Statute overview

About this statute

Companies covered by this regulation must pass on third-party fees, commissions, or other money or in-kind benefits to the customer as soon as possible after receiving them, when the amounts are received in connection with discretionary portfolio management or independent investment advice. A firm must keep meeting the conflict-of-interest and disclosure requirements while it pays fees, commissions, or non-monetary benefits, and it must tell the customer about them before the service is delivered. If a company uses a research payment account, it must give the customer specified cost information before providing investment or ancillary services, and it must also give annual information about total third-party research costs.
