About this statute

Netvirksomheder must have an internal monitoring program to prevent discriminatory conduct. Netvirksomheder skal føre og kontrollere et internt overvågningsprogram, udpege en uafhængig overvågningsansvarlig, og store netvirksomheder med mindst 100.000 tilsluttede elkunder skal have en ansat overvågningsansvarlig. The annual report must be dated and signed by the board, the director, and the independent monitoring responsible person; a yearly report must be published and notified to Forsyningstilsynet by 1 June of the following year; written communication with authorities must be digital. Forsyningstilsynet supervises the independence and qualifications of the monitoring responsible person, including that person’s employment relationship. Section 7 says complaints about non-compliance are sent to Forsyningstilsynet, violations of §§ 9-11 can be fined, and the regulation sets minimum content requirements and transition dates for network companies’ internal monitoring programs.
