Statute overview

About this statute

This preamble says the act on sickness benefits is being promulgated and states who can receive sickness benefits. The minister may set special rules for sickness benefits for seafarers. Sickness benefits are generally conditional on lawful residence in Denmark and taxable income in Denmark, but several exceptions apply for certain stays abroad and for persons covered by EU or international social security rules. Section 54 says who may receive sick pay, who pays it, and when employer follow-up steps must happen. The employer may report the absence and ask the municipality for early follow-up; the employee must be informed, may object, and may ask for early follow-up if recovery within 8 weeks is unlikely. Kommunen must follow up on sick-leave cases, assess entitlement, and arrange relevant support; the sick person must complete and answer the questionnaire and help with any medical certificate request.
