This preamble says the law implements parts of the EU Insurance Distribution Directive and sets the law’s scope, exclusions, definitions, and authorization requirement. Virksomheden skal have ansvarsforsikring eller tilsvarende garanti, beskytte kunderne mod formidlerens insolvens og sørge for, at en tilladelsesansøgning indeholder de krævede oplysninger. Applications and registrations must be submitted through Finanstilsynet’s online self-service channel, with an electronic fallback if that is not possible. Finanstilsynet must decide within 3 months after receiving all necessary information, and it must notify the applicant immediately. Section 16 requires insurance intermediaries to notify the Danish Financial Supervisory Authority of certain changes and annual business figures, meet fitness and conduct standards, keep confidentiality, run whistleblower arrangements in larger firms, and follow limits on remuneration and product distribution. Insurance intermediaries with Danish authorisation must notify Finanstilsynet before offering cross-border services or opening a branch abroad, and must report planned changes in advance.
