This preamble says the law implements EU rules on protection for workers if an employer becomes insolvent. Fonden may pay certain wage claims during reconstruction proceedings, and in some cases decide key timing/priority questions. The Fund does not pay holiday allowance on payments under subsection 2, but it may pay wages during holiday or holiday allowance in limited cases tied to the employee’s holiday period and whether the required amount has been paid into FerieKonto or a private holiday fund. Fonden may pay wage-related claims only when the claim has been reported, documented, and is due; employees and certain organizations must provide information on request; the minister may change the amount limits. Private employers in the stated registration categories must pay a contribution to cover the fund’s expenses, and the provision also gives the fund, the minister, and ATP powers for collection, recovery, and rulemaking.
