About this statute

The Kystdirektoratet decides whether certain coastal and sea-based activities caused environmental damage or an imminent risk of such damage, and the responsible operator must take immediate preventive or limiting steps and notify the Kystdirektoratet. Kystdirektoratet can order the responsible operator to provide information and carry out investigations about possible environmental damage, and can require property access and restoration measures. Kystdirektoratet must be given relevant information with the request, may refuse to decide if that information is missing, and must send and publish certain decisions. Complaints normally suspend the decision, but the board can decide otherwise. Complaints must be filed in writing through digital self-service to Kystdirektoratet, which must forward them to the board and handle later communication digitally. Section 6 says companies and other legal persons may be subject to criminal liability under chapter 5 of the Penal Code; the regulation starts on 9 December 2024 and repeals an older 2016 regulation.
