About this statute

This preamble says the holiday law secures employees’ right to annual leave and holiday pay, and it applies to persons doing personal work for pay, subject to specified exceptions. Section 15 limits when the law on holiday rules can be derogated from, and allows certain collective, local, and individual agreements to depart from some provisions under specified conditions. This section sets rules for earning and taking paid vacation, including accrual rates, timing, notice, and what happens if the employer changes vacation plans or the business closes. The section limits when a dismissed employee may take main holiday during the notice period, sets rules for holiday during release from work, sickness, strike/lockout and other holiday barriers, and gives employees a right to 5 weeks of holiday, with some periods unpaid if no paid holiday has been earned. A worker may, before the vacation year starts, choose vacation allowance instead of pay and holiday supplement, calculated at 12% of wages. An employee who leaves employment gets vacation allowance for earned paid vacation not yet taken. Vacation pay is the usual foreseeable pay at the vacation time, plus certain benefits, and employees keep a vacation-pay right tied to their pay level when working time changes.
