Statute overview

About this statute

This preamble says the Environmental Protection Act implements parts of several EU directives and sets general aims and powers for environmental administration. This section requires businesses and others to reduce resource use, pollution, and waste as much as possible, and it sets duties for polluters, manufacturers/importers, users/consumers, public authorities, and polluting enterprises. Miljøministeren may make rules on pollution control, reporting, approvals, inspections, authorisations, fees, and coercive fines for certain environmental matters. The minister may make rules on authorization schemes, complaints, advance funding, environmental labels, fees, and delegation of powers to boards or private organizations. Section 88 gives the minister broad rulemaking powers and sets several producer-responsibility, deposit-return, and environmental rules, including a ban on misleading sales and a duty to finance certain waste-handling systems.
