Statute overview

About this statute

Bekendtgørelsen applies to detainees in remand prisons and sets who manages custody, who may order isolation or restrict visits/correspondence, and when transfers must be notified. A detainee may be placed in a prison or hospital-type institution with consent; in limited cases the court may approve placement without the detainee’s consent, and the detainee may not leave the institution without court approval. Kriminalforsorgsområdet skal forelægge en overførselssag for Direktoratet for Kriminalforsorgen i visse alvorlige sager om en varetægtsarrestant. A remand prisoner must follow instructions given by the institution’s staff. Varetægtsarrestanter get rights to community, worship, communication, possessions, publications, and outdoor time, with some limits; they also must handle practical tasks as far as possible.
