Statute overview

About this statute

This provision says the law applies to Danish UCITS, sets some rules for foreign UCITS marketing in Denmark, defines key UCITS terms, and requires authorization and certain notices for master institutions. The provision requires feeder/master UCITS participants and custodians to exchange necessary information and have written agreements, and it requires Danish UCITS assets to be kept separately with an approved custodian. The provision sets rules for Danish UCITS marketing units abroad, requires notifications to Finanstilsynet and foreign authorities in some cases, and includes governance and remuneration rules for investment associations and SIKAVs. Bestyrelse, direktion og øvrige ledelsesmedlemmer skal sørge for, at årsrapporten for de nævnte fonde udarbejdes, underskrives, dateres og sendes til de relevante myndigheder til tiden. The Minister for Business Affairs may set rules on offsetting, and assets and liabilities must generally be measured at fair value unless § 95 provides otherwise.
