About this statute

The authority that created a zone reservation may lift it fully or partly, or change its conditions, with the consent of any adjudication holders. The corresponding measure must be published in the Official State Gazette and in the affected provincial bulletin. This article routes proceedings under the law to the Provincial Delegation of the Ministry of Industry and assigns final administrative decisions, depending on the law, to the Directorate General of Mines, the Minister of Industry, or the Council of Ministers. Los titulares legales de una concesión de explotación y los adjudicatarios de una zona de reserva definitiva tienen derecho a pedir expropiación forzosa u ocupación temporal de terrenos necesarios para sus trabajos e instalaciones. El titular de un permiso de investigación y el adjudicatario de una zona de reserva provisional tienen derecho a ocupar temporalmente los terrenos necesarios para sus trabajos y servicios, y ese derecho se prorroga automáticamente si se prorroga la vigencia del permiso o la reserva.
