La petición debe dirigirse al Ministerio de Obras Públicas y Urbanismo y presentarse en la Jefatura de Costas y Puertos correspondiente, con la documentación y datos exigidos. El proyecto del puerto debe ir firmado por un Ingeniero de Caminos, Canales y Puertos y visado por su Colegio, e incluir una memoria, planos, pliego técnico, presupuesto, estudio económico-financiero y reglamento de explotación. Los puertos deportivos deben respetar los intereses públicos, no ocupar una parte de la playa para su construcción salvo restitución artificial, y armonizar con el paisaje costero.
