Statute overview

About this statute

If maternity benefits can be claimed in both contracting parties under Article 9, they are paid exclusively by the competent institution in the party where the birth occurs. Workers employed in the territory of one contracting party are entitled to sickness-maternity benefits in certain temporary-stay cases, and the employment-country institution bears the cost. Workers receiving sickness or maternity benefits keep that right when they move to the other Contracting Party’s territory, if the competent institution authorizes it. The rules in articles 10, 12, and 13 also apply by analogy to the worker’s accompanying family members.
