Statute overview

About this statute

Extradition must be denied in the listed cases, including political crimes, certain military or complaint-based offences, exceptional courts, extinguished criminal liability, prior or ongoing proceedings in Spain, missing guarantees from the requesting State, and recognized asylum status. The court, justice ministry, foreign affairs ministry, government, and court clerk must carry out extradition-related communications and decisions after an extradition order or denial. When several States request extradition, the Government decides the extradition and any delivery of the requested person.
