Extradition must not be granted if criminal liability has been extinguished for any cause provided by the law of the requesting or requested party. La extradición puede denegarse si el delito está castigado con pena de muerte en el Estado requirente y esa pena no existe o no se ejecuta normalmente en el Estado requerido, salvo que haya seguridades suficientes de que no se ejecutará.
