The Royal Decree applies to certain public diffusion of films and audiovisual works on videographic media, but not to strictly domestic, non-networked diffusion or to cinema exhibition halls governed by specific law. The transmission referred to in Article 1 must not interfere with authorised telecommunications services, especially broadcasting and television. The Ministry of Transport, Tourism and Communications may suspend electrical installations and devices that cause harmful interference to communications and radio services. To distribute films and other audiovisual works under this decree, prior authorization from the rights holders or assignees is needed; collective management entities must contract with requesters in the specified case; rights holders may also require periodic supporting documentation in contracts; authors’ remuneration rights are preserved. The provision requires broadcasters to give users clear and sufficient information about their services, including programming, film ratings, price, and other legal terms. Certain service companies and homeowners’ associations must apply these rules with necessary adaptations, and some listed companies and associations must keep a user or subscriber register.
