About this statute

Es válido el arbitraje establecido en un testamento para resolver diferencias entre herederos no forzosos o legatarios sobre la distribución o administración de la herencia. Capital companies may submit disputes to arbitration, and bylaws may also send challenges to corporate resolutions to arbitrators. A court award that voids a registrable corporate resolution must be entered in the Mercantile Register, and an extract must be published in the Official Gazette of the Mercantile Register. The arbitration agreement binds the parties, can keep courts from hearing arbitrated disputes if properly raised by declinatoria, and does not stop interim measures from being requested or granted.
