When a survivor pension is requested after the death of an old-age or disability benefit holder, each competent institution must report the deceased’s benefit amount and the pension amount for dependents or beneficiaries, using the link/correlation form. If insurance periods under one year do not create benefit entitlement under one Party’s law, that Party’s institution must not grant a benefit for that period; the other Party’s institution may need to count those periods for entitlement and benefit amount under its own law. This article treats certain conditions for recognizing benefits as satisfied across the two Parties in specified cases, and lets reduction, suspension, or cancellation clauses apply to pensioners who work even if they work in the other Party’s territory. The designated liaison bodies and competent institutions must share needed information, carry out medical exams when requested, and exchange statistics and other application data for benefits administration.
