Statute overview

About this statute

This article sets fine ranges for minor, serious, and very serious infringements, and requires aggravating factors to be considered when setting the amount. This article defines when there is repeat offending: if, when committing an infringement, the offender has already been sanctioned by a final administrative decision. Cancelled infringing records are not counted. Sanction records are considered cancelled after 2 years for minor infringements, 3 years for serious infringements, and 5 years for very serious infringements, counted from the day after the sanction decision becomes final. Town councils must carry out inspection and procedural investigation duties under this Law, and the competent authorities may impose sanctions, including fines up to 60,000 euros. The municipalities and the competent commerce department may impose coercive fines up to 6,000 euros.
