About this statute

Las autoridades competentes deben graduar las sanciones con proporcionalidad, y en ciertos casos pueden aumentar multas, ordenar indemnizaciones, o imponer cierre o suspensión. The competent department’s secretary general has the power to impose sanctions on entities covered by this law. Las resoluciones sancionadoras pueden ordenar corregir la infracción y fijar un plazo; si no se corrige, la Administración puede imponer multas coercitivas y, en ciertos casos, ejecutar la corrección subsidiariamente. In extraordinary urgent cases involving risks to users’ health and safety, the sanctioning authority may order provisional protective measures, including suspending the service or establishment. The competent authority may adopt motivated precautionary measures during the sanctioning procedure, and those measures must be proportionate and lifted if the reasons for them disappear.
