Statute overview

About this statute

This article sets procurement requirements for funded works: they must be newly planned and immediate, meet value limits, use permitted tender procedures, and in one exceptional case the Ministry may authorize direct execution by a small municipality. Municipalities must file one funding application per investment project electronically within the Article 4 deadline, and the application must include the required documents. The Government delegations must check investment project applications within 10 days and report the result electronically; the Secretary of State must then decide on financing, publish the decision, and may request extra information. If the Secretary of State for Territorial Cooperation authorizes direct execution of the works by the City Council, the General Directorate of Local Cooperation must release 85% of the authorized amount plus recoverable VAT or an equivalent tax.
