Statute overview

About this statute

The insolvency administrator may arrange additional liability insurance coverages and expand the scope and limits of coverage, if the parties freely agree. The injured person or their heirs may bring a direct action against the insurer to demand indemnity, and the insured must tell them that the insurance contract exists when that direct action is used. The bankruptcy administrator may replace the insurance with an equivalent joint guarantee from a credit institution, and the guarantee must stay valid for four years after the administrator leaves office. When appointed, the insolvency administrator must prove that liability insurance or an equivalent guarantee is in force. The insolvency administrator must have insurance or an equivalent guarantee, unless a stated public-sector exception applies.
