Statute overview

About this statute

The minutes of the relevant Government meetings must expressly record the total number of attendees, the result of the vote or votes, and the reasons supporting the adopted agreement. The interim presidency cannot last more than four months, and the designated interim officeholder must exercise the Lehendakari’s functions except for specific excluded powers. Si pasan cuatro meses seguidos y siguen existiendo las causas del artículo 9.º, el Lehendakari impedido debe cesar de inmediato. The Lehendakari must cease in office after general elections, in certain loss-of-confidence cases, on resignation, or on death. After cessation, the outgoing Lehendakari and government normally continue in office until the new Lehendakari takes office, except if the cessation is due to death or incapacity. When the Lehendakari is replaced, succession follows a set order. An acting Lehendakari may not raise a vote of confidence or be subject to a motion of censure, except as provided for the interim Lehendakari in Article 11.
