About this statute

Las autoridades de telecomunicaciones pueden pedir información a operadores y otros agentes del mercado, y quienes reciban el requerimiento deben entregarla en el plazo y forma fijados; las autoridades deben mantener la confidencialidad. El Ministerio de Industria, Energía y Turismo y la CNMC deben fomentar y garantizar el uso de determinadas normas o especificaciones técnicas para comunicaciones electrónicas. Public network operators have a right, and sometimes a duty, to negotiate mutual interconnection; operators may not block such negotiations, and information shared in negotiations must be used only for the intended purpose and kept confidential. The CNMC must define reference electronic communications markets, review them on set timelines, identify significant market power where competition is lacking, and impose or remove specific obligations as needed. The regulator may impose specific obligations on operators with significant market power, and the Government sets the framework by royal decree.
