Statute overview

About this statute

Las sanciones por infracciones prescriben en 1, 2 o 3 años según sean leves, graves o muy graves. Sanctions are to be set based on listed aggravating or mitigating circumstances, and repairing the infringement in the stated period counts as a mitigating circumstance. This article assigns sanctioning powers to the competent department and its officials, depending on the seriousness of the infringement. The express resolution must be notified within one year from the start of the sanctioning procedure. Inspection reports prepared by authorized staff are treated as public documents and may be used as proof of the reported facts. A copy must be given to the alleged offender at the time of the report, or later when the procedure is initiated if immediate delivery is not possible.
