About this statute

Regulates succession pacts: the property holder may dispose mortis causa by pact, some succession rights may be renounced or disposed of in specified cases, the grantors must be adults, and the pact must be made in a public deed. A pacto sucesorio designation can отменate earlier testamentary dispositions over the covered assets, and the designation can only be changed or ended by a new pact or by grounds set by the parties. La donación mortis causa de bienes singulares se trata como pacto sucesorio; la donación universal inter vivos también, salvo pacto en contrario. El pacto de designación de sucesor puede incluir la disposición de la herencia y su renuncia. La designación sucesoria transmite al sucesor la titularidad de los bienes, pero puede estar sujeta a limitaciones pactadas; salvo pacto en contrario, la disposición o gravamen de esos bienes necesita el consentimiento conjunto del instituyente y el instituido. Los acreedores del instituyente tienen preferencia sobre los bienes transmitidos por deudas previas al pacto.
