For new or fully rehabilitated homes under the rent-cap regime, the initial rent cannot exceed the upper limit of the reference rent index for a comparable home in the same urban area, unless public subsidies were used for the works. For certain rent-controlled leases, a landlord who makes improvement works may raise the rent after the minimum mandatory contract term has passed, and the increase is not subject to the article 6 cap. If a landlord in a rent-containment tenancy charges rent above the Article 6 limits, the tenant has a right to recover the overpaid amount plus legal interest increased by three points.
