Statute overview

About this statute

This segment sets up the EU AML/CFT Authority and gives it supervisory, coordination, information-gathering, and sanctioning powers. This provision gives the Authority peer-review, investigation, coordination, FIU.net, and information-sharing powers, while also setting duties on the Commission and response duties for FIUs. This provision establishes the EU AML/CFT Authority and sets out its main tasks and powers. The Authority can request information, carry out investigations and on-site inspections, and use administrative measures, sanctions, and periodic penalty payments to enforce AML/CFT rules. The Authority can ask the Commission to temporarily transfer supervision tasks and powers if a request is ignored or no follow-up information is given in time. The Commission must decide within one month, and the transfer later ends automatically when the set time limit expires unless extended once.
