| Official Journal of the European Union | EN L series ---|---|--- * * * | 2024/2962 | 2.12.2024 ---|---|--- COMMISSION IMPLEMENTING DECISION (EU) 2024/2962 of 29 November 2024 amending Implementing Decision (EU) 2019/1698 on European standards for products drafted in support of Directive 2001/95/EC of the European Parliament and of the Council on general product safety, on the withdrawal of the publication of the references of the standards EN 581-1:2006 (Outdoor furniture – Seating and tables for camping, domestic and contract use – Part 1: General safety requirements), EN 12491:2001 (Paragliding equipment – Emergency parachutes – Safety requirements and test methods), EN 1651:1999 (Paragliding equipment – Harnesses – Safety requirements and strength tests) and EN 1273:2005 (Child use and care articles – Baby walking frames – Safety requirements and test methods) in the Official Journal of the European Union (Text with EEA relevance) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Directive 2001/95/EC of the European Parliament and of the Council of 3 December 2001 on general product safety (1), and, in particular, the third and fourth subparagraphs of Article 4(2) thereof, Whereas: (1) | Article 3(1) of Directive 2001/95/EC requires producers to place only safe products on the market. ---|--- (2) | Under the second subparagraph of Article 3(2) of Directive 2001/95/EC, a product is to be presumed safe, as far as the risks and risk categories covered by the relevant national standards are concerned, when it conforms to voluntary national standards transposing Union standards. The references to these standards have been published by the Commission in the Official Journal of the European Union in accordance with Article 4 of that Directive. ---|--- (3) | In accordance with Commission Implementing Decision (EU) 2019/1698 (2), the Commission published in the Official Journal of the European Union the references of standards EN 581-1:2006 ‘Outdoor furniture – Seating and tables for camping, domestic and contract use – Part 1: General safety requirements’, EN 12491:2001 ‘Paragliding equipment – Emergency parachutes – Safety requirements and test methods’, EN 1651:1999 ‘Paragliding equipment – Harnesses – Safety requirements and strength tests’, and EN 1273:2005 ‘Child use and care articles – Baby walking frames – Safety requirements and test methods’. ---|--- (4) | The European Committee for Standardization (CEN) has withdrawn standards EN 12491:2001, EN 1651:1999 and EN 1273:2005 from its database. Standard EN 581-1:2006 does also not reflect anymore the state of the art. The Commission thus considers that these standards can no longer ensure compliance with the general safety requirement and their reference, should, as a result, be withdrawn from the list of references of standards published in the Official Journal of the European Union, contained in Implementing Decision (EU) 2019/1698. ---|--- (5) | The voluntary national standards transposing those Union standards should thus no longer grant a presumption of safety to those products complying with them that will be placed on the market after the entry into force of this Decision. ---|--- (6) | The measures provided for in this Decision are in accordance with the opinion of the General Product Safety Committee established by Article 15 of Directive 2001/95/EC, ---|--- (7) | After consultation of the Committee on Standards established by Article 22 of Regulation (EU) No 1025/2012 of the European Parliament and of the Council (3) on European standardisation, ---|--- HAS ADOPTED THIS DECISION: Article 1 The references to the following standards shall be withdrawn from the list of references of standards published in the Official Journal of the European Union. — | EN 581-1:2006 Outdoor furniture – Seating and tables for camping, domestic and contract use – Part 1: General safety requirements [Row 1 to Annex I deleted], ---|--- — | EN 12491:2001 Paragliding equipment – Emergency parachutes – Safety requirements and test methods [Row 35 to Annex I deleted], ---|--- — | EN 1651:1999 Paragliding equipment – Harnesses – Safety requirements and strength tests [Row 15 to Annex I deleted], ---|--- — | EN 1273:2005 Child use and care articles – Baby walking frames – Safety requirements and test methods [Row 13 to Annex I deleted]. ---|--- Article 2 This Decision shall enter into force the day following that of its publication in the Official Journal of the European Union.
