This regulation enters ‘Nougat de Montélimar’ in the EU geographical indications register and lets Bargues Agro-Industrie keep using three named product labels for 5 years from the regulation’s entry into force.
| Official Journal of the European Union | EN L series ---|---|--- * * * | 2024/2921 | 26.11.2024 ---|---|--- COMMISSION IMPLEMENTING REGULATION (EU) 2024/2921 of 19 November 2024 laying down rules for the application of Regulation (EU) 2024/1143 of the European Parliament and of the Council as regards the entering of a geographical indication in the Union register of geographical indications (‘Nougat de Montélimar’ (PGI)) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) 2024/1143 of the European Parliament and of the Council of 11 April 2024 on geographical indications for wine, spirit drinks and agricultural products, as well as traditional specialities guaranteed and optional quality terms for agricultural products, amending Regulations (EU) No 1308/2013, (EU) 2019/787 and (EU) 2019/1753 and repealing Regulation (EU) No 1151/2012 (1), and in particular Article 21(2) thereof, Whereas: (1) | Pursuant to Article 50(2)(a) of Regulation (EU) No 1151/2012 of the European Parliament and of the Council (2), France’s application for registration of the geographical indication ‘Nougat de Montélimar’, which the Commission had received before the date of entry into force of Regulation (EU) 2024/1143, was published in the Official Journal of the European Union (3). ---|--- (2) | No statement of opposition under Article 17 of Regulation (EU) 2024/1143, which is applicable to the application for registration in accordance with Article 90(2) of that Regulation, has been received by the Commission. ---|--- (3) | The geographical indication ‘Nougat de Montélimar’ should therefore be entered in the Union register of geographical indications. ---|--- (4) | By letter received on 22 September 2023, the French authorities informed the Commission that Bargues Agro-Industrie, 7 Courtès – 46340 Lavercantière (SIRET: 338 615 958 00018), which is established on their territory outside the geographical area concerned, had been legally marketing the product sold under the names ‘Pâte de nougat Montélimar’ / ‘Montelimar nougat paste’ / ‘patanouga Montélimar’ containing nougat that did not comply with the product specification, using these names continuously for more than 5 years, and that this point had been raised during the national opposition procedure. ---|--- (5) | Since the company Bargues Agro-Industrie meets the requirements laid down in Article 20(1) of Regulation (EU) 2024/1143, also applicable to the application for registration in accordance with Article 90(2) of that Regulation, for the granting of a transitional period in which to make legal use of the sales name after registration, it should be granted a transitional period of 5 years during which it may make use of the names ‘Pâte de nougat Montélimar’ / ‘Montelimar nougat paste’ / ‘patanouga Montélimar’, ---|--- HAS ADOPTED THIS REGULATION: Article 1 The geographical indication ‘Nougat de Montélimar’ (PGI) is hereby entered in the Union register of geographical indications referred to in Article 22 of Regulation (EU) 2024/1143. Article 2 The company Bargues Agro-Industrie, 7 Courtès – 46340 Lavercantière (SIRET: 338 615 958 00018) is hereby authorised to continue to use the names ‘Pâte de nougat Montélimar’ / ‘Montelimar nougat paste’ / ‘patanouga Montélimar’ for a transitional period of 5 years from the entry into force of this Regulation. Article 3 This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
