13.1.2022 | EN | Official Journal of the European Union | L 8/142 ---|---|---|--- * * * COMMISSION IMPLEMENTING DECISION (EU) 2022/39 of 12 January 2022 laying down rules on the format and timetables for the submission of national work plans and annual reports on data collection in the fisheries and aquaculture sectors, and repealing Implementing Decisions (EU) 2016/1701 and (EU) 2018/1283 THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) 2017/1004 of the European Parliament and of the Council of 17 May 2017 on the establishment of a Union framework for the collection, management and use of data in the fisheries sector and support for scientific advice regarding the common fisheries policy and repealing Council Regulation (EC) No 199/2008 (1), and in particular Articles 6(5) and 11(1) thereof, Whereas: (1) | Regulation (EU) No 1380/2013 of the European Parliament and of the Council (2) requires the Member States to collect biological, environmental, technical and socioeconomic data necessary for fisheries management. ---|--- (2) | According to Article 6(1) of Regulation (EU) 2017/1004, the Member States are to collect such data within the framework of a national work plan. Such plans, to be submitted to the Commission by 15 October of the year preceding that from which they apply, are to be drawn up in accordance with the multiannual Union programme for the collection, management and use of data in the fisheries and aquaculture sectors (‘EU MAP’). ---|--- (3) | The EU MAP is provided for by Commission Delegated Decision (EU) 2021/1167 (3) and Commission Implementing Decision (EU) 2021/1168 (4). ---|--- (4) | According to Article 6(5) of Regulation (EU) 2017/1004, the Commission may adopt implementing acts laying down rules on procedures, format and timetables for the submission of these work plans. ---|--- (5) | It is appropriate to lay down the format of the national work plans, in accordance with the data requirements laid down in the EU MAP. In order to ensure compliance with the submission deadline of national work plans applicable for the period from 2022, which is 15 October 2021, the format provided for by this Decision was made available to the Member States on 19 July 2021 and the Member States agreed to submit their work plans based on this format. ---|--- (6) | The period of validity of national work plans used to match the EU MAP timeframe. The current EU MAP will not expire on a set date, hence the validity period of the national work plans should be laid down in this Decision. The first national work plans submitted in accordance with this Decision should cover a period of three to six years starting from 1 January 2022, to provide necessary stability of data collection. The application period of single or successive national work plans should not exceed 31 December 2027, to align with the programming period of Regulation (EU) 2021/1139 establishing the European Maritime, Fisheries and Aquaculture Fund (5). ---|--- (7) | According to Article 11(1) of Regulation (EU) 2017/1004, the Member States are to submit to the Commission annual reports on the implementation of their national work plans for data collection in the fisheries and aquaculture sectors. The Commission may adopt implementing acts laying down rules on procedures, format and timetables for the submission and approval of those reports. ---|--- (8) | It is appropriate to lay down the format of the annual reports in accordance with the data requirements laid down in the EU MAP. As the annual reports and the national work plans are based on the same format, that format should be used by the Member States for reporting on the implementation of the national work plans that will be in place from 1 January 2022. ---|--- (9) | As the annual reports and the national work plans are based on the same format, the format from Commission Implementing Decision (EU) 2018/1283 (6) should be used by the Member States for reporting on the implementation of the national work plans in place for the year 2021. ---|--- (10) | In order to allow for timely disclosure of the outcomes of national data collection work plans and timely provision of data to end users, the deadline for the submission of the annual reports should be set as 31 May of the year following the year in which the work plan has been implemented. ---|--- (11) | The Commission has taken into account the recommendations made by the Scientific, Technical and Economic Committee for Fisheries (7). Representatives of the Member States gathered in dedicated expert groups have also been consulted. ---|--- (12) | Commission Implementing Decisions (EU) 2016/1701 (8) and (EU) 2018/1283 lay down rules on the submission of the national work plans and annual reports in accordance with the data requirements of the previous EU MAP. Those Decisions should be repealed, as this Decision provides for the rules for the submission of those plans and reports in accordance with the new data requirements. ---|--- (13) | The measures provided for in this Decision are in accordance with the opinion of the Committee for fisheries and aquaculture, ---|--- HAS ADOPTED THIS DECISION: Article 1 Content and application period of work plans 1\. The format of the national work plans for data collection, in accordance with the multiannual Union programme for the collection, management and use of data in the fisheries and aquaculture sectors (‘EU MAP’) established by Commission Delegated Decision (EU) 2021/1167 and Commission Implementing Decision (EU) 2021/1168, is set out in the Annex to this Decision. 2\. The first national work plans shall cover a period of minimum 3 years and maximum 6 years, starting on 1 January 2022 and ending, at the latest, on 31 December 2027. The application period of any successive national work plans shall end, at the latest, on 31 December 2027. Article 2 Content and deadline for the submission of annual reports 1\. Annual reports on the implementation of data collection work plans in accordance with the EU MAP shall be submitted in accordance with the format set out in the Annex to this Decision. 2\. The Member States shall submit, by 31 May of each year, the annual reports concerning the implementation of data collection work plans in the previous calendar year. Article 3 Repeal of Implementing Decisions (EU) 2016/1701 and (EU) 2018/1283 1\. Implementing Decisions (EU) 2016/1701 and (EU) 2018/1283 are repealed. 2\. By 31 May 2022, the Member States shall submit the annual reports based on the format from Commission Implementing Decision (EU) 2018/1283. Article 4 Entry into force This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union. This annex lists these tables and text boxes, and describes their fields. Where a Member State does not conduct data collection in sectors covered by certain tables or text boxes, it is not obliged to submit the corresponding tables or text boxes in the work plan (WP) or annual report (AR). Member States shall indicate by (Y/N) in the summary table of the WP which tables and text boxes are included and which are not. The grey-shaded sections of tables and text boxes relate only to the annual reports. The remaining sections relate to the work plans and must be copied unaltered to the relevant annual report. Columns containing formulas should fill in automatically. I.2 Compiling the annual report Member States shall first transfer the information from their adopted work plans to each corresponding table and text box in the annual report, and then fill in the additional grey-shaded columns. When compiling the annual report, Member States shall not edit any values in tables or text boxes that originate from their accepted work plans, with the exception of: — | Table 1.2: meetings not included in the work plan may be inserted as additional rows, highlighted in grey, at the end of the table. ---|--- — | Table 1.3: new agreements not included in the work plan may be inserted as additional rows, highlighted in grey, at the end of the table. ---|--- — | Table 2.1: species not included in the work plan may be inserted as additional rows, highlighted in grey, at the end of the table. ---|--- — | Table 2.2: new species, parameters or sampling schemes not included in the work plan may be inserted as additional rows, highlighted in grey, at the end of the table. ---|--- — | Table 2.5: new sampling schemes or frames not included in the work plan may be inserted as additional rows, highlighted in grey, at the end of the table. ---|--- Table 1.4 applies only to the annual report. Member States shall use it to specify their follow-up to the recommendations and agreements related to the data collected under the DCF at EU and international level. Where necessary, Member States shall explain deviations from the work plan in the relevant ‘AR comments’ in the tables, and in the text boxes in the annual report. In the text boxes, they shall specify actions that will be taken to avoid deviations from the work plan in the future. I.3 Consistent naming and codification, compliance with conventions Member States shall apply consistent naming and coding of gears, species, metiers, fishing grounds and alike throughout the tables and text boxes of the work plans and annual reports. Where applicable, Member States shall use codes and names from relevant tables in the annexes to the EU MAP decisions and other international conventions, including those agreed by regional coordination groups. If a Member State operates in several regions, it shall present its data collection activities per region, for biological data, and per supra region, for economic data. The regional stratification is included in Table 2 of the Annex to Commission Implementing Decision (EU) 2021/1168. The Member State shall present its activities outside EU waters grouped in regional sections and within the region, by regional fisheries (management) organisation or other international organisation. The same division shall be maintained throughout the tables and the text boxes in the work plans and annual reports. II – Description of tables and text boxes 1: General information Data collection framework at national level General comment: Use this text box to describe how data collection is organised in your Member State (institutions involved, contact information) and in which regional coordination groups (RCG) your Member State participates. --- Outline the general framework of the national data collection programme in relation to the relevant sections of the EU MAP. If applicable, indicate major methodological changes in approach compared to previous year(s), and to which section(s) they apply. Give full name, acronym and contact details of all institutes that contribute to the data collection activities, and describe briefly their role in the work plan. Provide a link to the national data collection website, if there is one. This table is intended to specify data to be collected under Table 1 of the EU MAP Delegated Decision annex. Use this table to give an overview of the collection of data at the level of area/stock. All individuals sampled shall be identified to species level and have length measurements taken, where possible. Other biological data different from length are specified in Table 2.2, and may include data collected under the surveys at sea. --- Field name | Description MS | Use ISO 3166-1 alpha-3 code e.g. ‘DEU’. See MasterCodeList ‘MS’. Reference period | Indicate the year(s) to which the data actually refer. When the fleet operates in a combined region (e.g. Mediterranean and Black Sea), list all species for that region. You may add additional rows, at the end, for species or stock not included in Table 1 of the EU MAP Delegated Decision annex, for which sampling is required by your Member State, RFMOs or is agreed at marine region level. Justify such an inclusion in the ‘WP comments’ column. Area | Indicate the area for the mentioned species/stock, in accordance with column 3 of Table 1 of the EU MAP Delegated Decision annex. Average landings in the reference years (tonnes) | Enter the average landings per year in the statistics reference period for each species and stock. If the species is not landed at all, then enter ‘None’. Provide the exact number of tonnes without decimal positions. Data source used for average national landings | Enter the data source for the average national landings. See MasterCodeList ‘Data Source’. EU TAC (if any) (%) | Only applies to stocks that are subject to TAC and quota regulations. Enter ‘None’, if your Member State has no share in the EU TAC of the stock concerned. Enter the percentage of the share (value between 0 and 100) if your Member State has a share in the EU TAC of the stock concerned. If the TAC refers to several combined species, enter the percentage of the share in the TAC for each species and indicate the combination in the ‘WP comments’ column. In case of a significant quota swap (more than 50 % of the TAC share), indicate the volume of the swap in the ‘WP comments’ column. Enter ‘NA’ if the stock is not managed by TAC. In this case fill in the ‘Share (%) in EU landings’ column. Share (%) in EU landings | Applies to all stocks for which no TACs have been defined (yet). Enter ‘None’, if your Member State has no landings of the stock concerned. Enter the percentage of the share (value between 0 and 100), if your Member State has landings of the stock concerned. Data source used for EU landings | Enter the data source for EU landings. See MasterCodeList ‘Data source’. Threshold rules used | Indicate which threshold rules apply, when a species is not selected for sampling. For species that are selected for sampling enter ‘None’. For diadromous species enter ‘None’, as no thresholds apply to them under the EU MAP. Use the hierarchy of rules: 1) ‘TAC < 10 %’, 2) ‘Landings < 10 %’, 3) ‘Landings < 200t’. Regional coordination agreement at stock level | Enter ‘Y’ (yes) or ‘N’ (no) if there is a regional agreement on sampling the stock. Text Box 2.1: List of required species/stocks General comment: This text box fulfils Article 5(2)(a), Article 6(3)(a), (b) and (c) of Regulation (EU) 2017/1004 and Chapter II point 2.1(a) of the EU MAP Delegated Decision annex. This text box applies to the annual report and complements Table 2.1. --- Deviations from the work plan List the deviations (if any) in the achieved data collection (lengths only) compared to what was planned. The Member State shall list the sampling frames within the scheme, the primary sampling unit (PSU) type and the envisaged number of PSUs that will be available in the year of submission. Actions to avoid deviations Briefly describe the actions that will be considered/have been taken to avoid deviations in the future and when these actions are expected to produce an effect. If there are no deviations, then this section is not applicable. (max. 900 words) III – Quality reports enclosed in the work plans and the annual reports The work plans and the annual reports shall include annexes with quality reports. The templates for these annexes are listed below. White fields shall be filled in for the work plan, grey fields apply to the annual report. ‘ANNEX 1.1 – Quality report for biological data sampling scheme’ Use this annex to state whether documentation in the data collection process (design, sampling implementation, data capture, data storage, sample storage and data processing) exists and identify where this documentation can be found. Provide short descriptions where indicated, even if the documentation can be found in English. Names of sampling schemes and strata shall be identical to those in Tables 2.2, 2.3, 2.4, 2.5, 2.6 and 4.1 of the WP/AR. For quality information on scientific surveys, use the survey acronym as a sampling scheme identifier. For mandatory surveys, refer to Table 1 of the EU MAP Implementing Decision annex, see also MasterCodeList ‘Mandatory survey at sea’. Description of the population Population targeted: Specify the primary sampling units (PSUs), e.g. all national port*days (information present in former Table 4B). For research surveys: specify the main target species from a survey perspective (as opposed to Table 1 in the Annex to the Implementing Decision) and the main survey area. Population sampled: Specify which part of the target population will be sampled and specify which part of the target population is unreachable for sampling or excluded for some reason, e.g. major ports being listed as auctions excluding all minor ports and no sampling during the week-ends. For research surveys at sea describe target species in single-species surveys or ecosystem components (e.g. demersal, pelagic) in multispecies surveys. Stratification: Explain the logic taken to stratify the population and the number of strata generated, e.g. population stratified in three geographical lots (from A to B, from B to C and from C to D).
